1. About Us
Smarty Pants Tutoring ("Smarty Pants", "we", "us") provides online and curriculum-aligned tutoring services to learners in South Africa. By using our website or services you agree to these Terms.
2. Services
We deliver 1-on-1 and small-group tutoring across CAPS, IEB and Cambridge curricula, plus supporting tools (quizzes, homework tracking, progress reports). Tutors are independent contractors vetted by us.
3. Bookings & Payments
Sessions are booked in advance via our website or staff. Payment is due before each lesson or monthly package start date. We accept EFT and online card payments. Prices are in South African Rand (ZAR) and include VAT where applicable.
4. Cancellations & Refunds
Cancellations made more than 24 hours before a session are credited in full. Cancellations within 24 hours are not refundable but may be rescheduled at our discretion. Monthly packages are non-refundable once the first session of the month has occurred but unused sessions may roll over by one month.
5. Code of Conduct
Students, parents and tutors are expected to behave respectfully at all times. Harassment, abuse or any unlawful behaviour will result in immediate termination of services without refund. Sessions may be recorded for safeguarding and quality purposes; recordings are stored securely and accessible only to the learner, parent and assigned tutor.
6. Safeguarding of Minors
All tutors agree to our Safeguarding Policy. Parents/guardians remain responsible for the supervision of minors during online sessions. We recommend sessions take place in a shared family space.
7. Intellectual Property
All study materials, quizzes, worksheets, recordings and platform content are owned by Smarty Pants and licensed to you for personal, non-commercial use only. You may not redistribute, resell or publish our content.
8. Limitation of Liability
We make no guarantee of specific academic outcomes. To the maximum extent permitted by law, Smarty Pants is not liable for indirect, incidental or consequential damages arising from your use of our services. Our total liability for any claim is limited to the fees you paid us in the preceding three months.
9. Privacy
Our processing of personal information is governed by our Privacy Policy, which forms part of these Terms.
10. Changes
We may update these Terms from time to time. Continued use of our services after we publish updated Terms constitutes acceptance of the changes.
11. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Disputes will be resolved in the courts of Johannesburg.
